ABSTRACT:
A defendant is criminally responsible only if he engaged in a wrongful act, or actus reus (e.g., for larceny, voluntarily taking someone else's property without permission), with a guilty mind, or mens rea (e.g., knowing he had taken someone else's property without permission, and intending not to return it), and lacks affirmative defenses (e.g., the insanity defense). We therefore first review neuroscientific studies that inform the nature of voluntary action and so could tell us something of importance about the actus reus of crimes. Then we look at studies of intention, perception of risk, and other mental states that matter to the mens rea of crimes. Lastly, we discuss studies of self-control, which might be relevant to some formulations of the insanity defense. As we show, to date, very little is known about the brain that is of significance for understanding criminal responsibility, although there is potential for work of importance.

Our intuitive concept of the relations between brain and mind is increasingly challenged by the scientific world view. Yet, although few neuroscientists openly endorse Cartesian dualism, careful reading reveals dualistic intuitions in prominent neuroscientific texts. Here, we present the “double-subject fallacy”: treating the brain and the entire person as two independent subjects who can simultaneously occupy divergent psychological states and even have complex interactions with each other—as in “my brain knew before I did.” Although at first, such writing may appear like harmless, or even cute, shorthand, a closer look suggests that it can be seriously misleading. Surprisingly, this confused writing appears in various cognitive-neuroscience texts, from prominent peer-reviewed articles to books intended for lay audience. Far from being merely metaphorical or figurative, this type of writing demonstrates that dualistic intuitions are still deeply rooted in contemporary thought, affecting even the most rigorous practitioners of the neuroscientific method. We discuss the origins of such writing and its effects on the scientific arena as well as demonstrate its relevance to the debate on legal and moral responsibility.

In the Libet paradigm, subjects move their hand at will and report when they first felt the urge to move; information about the upcoming movement was shown to exist in their brains up to 10 seconds before movement onset. These results led some to conclude that conscious decisions are not part of the causal chain leading to action. However, various conceptual and experimental criticisms were raised against this paradigm. This chapter focuses on the reliability of self-reporting intention onset. Research suggests that it is inaccurate and biased, varying considerably with the reporting method and possibly computed retrospectively from movement time. In fact, the idea of a clear onset of intention apparently relies on an intuitively appealing but increasingly challenged model of decision making. This chapter suggests that the Libet studies may be inherently flawed and that the field should not rely on self-reporting of intention onset.

Humans typically experience decisions like donating to charity or going on vacation as inherently up to them and thus entailing responsibility. However, recent results in neuroscience - Libet results - purportedly suggesting that predictive information about upcoming decisions exists in the brain well before subjects report deciding. Some have thus deduced that all decisions are made unconsciously and free will and moral responsibility are illusory.
However, the above experiments typically focused on arbitrary decisions - bearing no meaning consequence or purpose - while the free will debate focuses on deliberate decisions. We worked with patients implanted with intracranial electrodes for clinical purposes and with EEG subjects to elucidate the neural precursors of arbitrary and deliberate decisions. In particular, we were interested in predicting action contents before action onset online and in real time. In a more philosophical vein, we also investigated the potential ethical and legal repercussions of the Libet results.
We found that arbitrary decisions can be predicted earlier and at a higher accuracy than deliberate ones. In addition, the readiness potential, a precursor of movement on which much of the Libet paradigm relies, is much more apparent for arbitrary than deliberate decisions. We further demonstrated that, even at face value, the Libet results have little bearing on moral and criminal responsibility and debate their use in the “my brain made me do it” legal defence.
We therefore conclude that, at least at this time, drawing strong conclusions from the Libet and similar experiments about lack of free will or moral responsibility is, at best, too hasty.

To date the BIAL Foundation has supported 461 projects, more than 1000 researchers, with research groups in twenty-seven countries, resulting, until April 2013, in about 600 full papers, out of which 172 published in indexed international journals with an average impact factor of 3.6 and a substantial number of citations (1665).
Since 1996 the BIAL Foundation organizes the Symposia entitled "Behind and Beyond the Brain", a Forum that gathers well renowned neurosciences speakers and the BIAL Foundation Fellows which are spread around the world.
Classified as an institution of public utility, the BIAL Foundation includes among its patrons the Portuguese President, the Portuguese Universities Rectors' Council and the Portuguese Medical Association.

A defendant is criminally responsible for his action only if he is shown to have engaged in a guilty act—actus reus (eg for larceny, voluntarily taking someone else's property without permission)—while possessing a guilty mind—mens rea (eg knowing that he had taken someone else's property without permission, intending not to return it)—and lacking affirmative defenses (eg the insanity defense or self-defense). We therefore first review neuroscientific studies that bear on the nature of voluntary action, and so could, potentially, tell us something of importance about the actus reus of crimes. Then we look at studies of intention, perception of risk, and other mental states that matter to the mens rea of crimes. And, last, we discuss studies of self-control, which might be relevant to some formulations of the insanity defense. As we show, to date, very little is known about the brain that is of significance for understanding criminal responsibility. But there is no reason to think that neuroscience cannot provide evidence that will challenge our understanding of criminal responsibility.

Neural precursors of voluntary actions appear before subjects report having decided on their behavior, leading some to dismiss a causal role for consciousness in decision-making. But the voluntary actions studied are typically arbitrary – bearing no purpose, meaning or consequence. We used EEG to directly compare deliberate and arbitrary decisions in a donation-preference task. Two NPOs appeared on the left/right of the screen, and subjects pressed the left/right button with the corresponding hand. In the deliberate condition, subjects’ choices led to monetary donations to the NPOs. In the arbitrary condition, both NPOs received donations irrespective of the choice. Early left/right ERP differences appeared ~1s before the action only for arbitrary decisions. Following our earlier work, we interpreted these ERPs as reflecting random bias activity disjoint from decision-making processes. Our findings challenge previous studies, suggesting that early predictability of voluntary action does not generalize from arbitrary to more-interesting deliberate decisions.

OBJECTIVE:
Motor-imagery (MI) classification base on electroencephalography (EEG) has been long studied in neuroscience and more recently widely used in healthcare applications such as mobile assistive robots and neurorehabilitation. In particular, EEG-based motor-imagery classification methods that rely on convolutional neural networks (CNNs) have achieved relatively high classification accuracy. However, naively training CNNs to classify raw EEG data from all channels, especially for high-density EEG, is computationally demanding and requires huge training sets. It often also introduces many irrelevant input features, making it difficult for the CNN to extract the informative ones. This problem is compounded by a dearth of training data, which is particularly acute for MI tasks, because these are cognitively demanding and thus fatigue inducing.
APPROACH:
To address these issues, we proposed an end-to-end CNN-based neural network with attentional mechanism together with different data augmentation (DA) techniques. We tested it on two benchmark MI datasets, Brain-Computer Interface (BCI) Competition IV 2a and 2b. BCI.
MAIN RESULTS:
Our proposed neural-network architecture outperformed all state-of-the-art methods that we found in the literature, with and without DA, reaching an average classification accuracy of 93.6% and 87.83% on BCI 2a and 2b, respectively. We also directly compare decoding of MI and ME tasks. Focusing on MI classification, we find optimal channel configurations and the best DA techniques as well as investigate combining data across participants and the role of transfer learning.
SIGNIFICANCE:
Our proposed approach improves the classification accuracy for MI in the benchmark datasets. In addition, collecting our own dataset enables us to compare MI and ME and investigate various aspects of EEG decoding critical for neuroscience and BCI.
